Acceptance of Terms

By accessing and using the website, services, and applications provided by ElkaHub Ltd for the Kooperacia condominium management platform (“Service”), you agree to be bound by these Terms of Use (“Terms”). If you do not agree to these Terms, please do not use our Services.

Changes to Terms

ElkaHub reserves the right, at its sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

Use of Services

  • Eligibility: You must be at least 16 years old to use the Services. If you are between 16 and 18 years old, you must have your parent or guardian’s permission to use the Services.
  • Account Registration: You may need to register for an account to access certain Services. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
  • Prohibited Activities: You are responsible for all your activity in connection with the Services. You may not use the Services for any purpose that is unlawful or prohibited by these Terms.

User-Generated Content and Community Standards

The Services let you post bulletins, vote in polls, send chat messages, and otherwise share content with other residents of your building. By posting any such content, you agree to the following:

  • Zero tolerance for objectionable content. We have a strict zero tolerance policy for objectionable content and abusive behavior, including but not limited to: harassment, threats, hate speech, sexual content, violent content, spam, and impersonation. Content that violates these standards will be removed and the offending user may be ejected from the platform without notice.
  • Zero tolerance for abusive users. Users who repeatedly violate these standards, or who engage in a single sufficiently serious violation, will have their accounts terminated and may be permanently banned from creating new accounts.
  • Report mechanism. Every piece of user-generated content in the Services has a Report option. Reports are reviewed by our moderation team and acted upon within 24 hours of submission — offending content is removed and offending users are ejected as appropriate.
  • Block mechanism. You may block any other user at any time. Once blocked, that user's content disappears from your view of the Services immediately. We are notified of every block so we can review the underlying behavior.
  • Your responsibility. You are solely responsible for the content you post and the consequences of posting it. You must own or have the necessary rights to any content you share, and you must not infringe the rights of others.

Intellectual Property

All content provided on the Services, including but not limited to text, graphics, logos, images, and software, is the property of ElkaHub or its content suppliers and protected by intellectual property laws. You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Service without express written permission from ElkaHub.

Privacy Policy

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your personal information. By using our Services, you agree to the terms of our Privacy Policy.

Termination

ElkaHub may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

Disclaimer of Warranties

The Service is provided on an “AS IS” and “AS AVAILABLE” basis. ElkaHub makes no representations or warranties of any kind, express or implied, as to the operation of their services, or the information, content, materials, or products included on this service.

Limitation of Liability

In no event shall ElkaHub, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of or inability to access or use the Services.

Governing Law

These Terms shall be governed and construed in accordance with the laws of Bulgaria, without regard to its conflict of law provisions.
